1. THESE TERMS

1.1 What these terms cover

These terms and conditions set out the agreement between you and us for the delivery of the OnTrack in 8 Accountability Membership (“the Membership”).

Please read them carefully before joining. By purchasing the Membership, you agree to be bound by these terms.

1.2 Definitions

“You” or “your” means the individual purchasing and participating in the Membership.
“We”, “us” or “our” means Nikki Gundy On Track Limited.

3. THE MEMBERSHIP CONTRACT

3.1 How the contract is formed

A legally binding contract comes into effect when your payment for the Membership is successfully processed via our website or payment platform.

3.2 Minimum commitment

The Membership has a minimum commitment period of eight (8) weeks from your start date.

During this minimum period:

  • the Membership cannot be cancelled; and

  • no refunds are available, except where required by law.

3.3 Ongoing subscription

After the initial 8-week minimum commitment, the Membership continues on a rolling monthly basis unless cancelled in accordance with Section 10.

4. THE ONTRACK in 8 MEMBERSHIP

4.1 What is included

The Membership provides accountability support which may include:

  • daily morning and evening check-ins via WhatsApp

  • access to structured community chat spaces

  • access to a coaching room for questions, concerns, and support

  • bi-weekly check-in forms

  • bi-weekly group coaching podcast episodes

  • general accountability guidance and facilitation

The Membership does not include:

  • 1:1 coaching

  • therapy, counselling, or medical advice

  • personalised responses to every message or check-in

4.2 Delivery format

The Membership is delivered primarily via WhatsApp and audio content. We reserve the right to change delivery methods provided the nature of the Membership remains materially the same.

5. YOUR RESPONSIBILITIES

5.1 Participation

You agree to:

  • engage respectfully within the community

  • follow the structure and guidance provided

  • use the appropriate community spaces as instructed

  • take responsibility for your own actions and wellbeing

5.2 Health disclaimer

You confirm that you are responsible for your own physical and mental health. If you have any medical or psychological conditions, you should seek professional advice before participating.

6. COMMUNITY CONDUCT

You agree to:

  • keep all community content confidential

  • not share screenshots, recordings, or member information

  • communicate respectfully and appropriately

  • not provide unsolicited coaching or advice to other members

We reserve the right to remove or suspend any member whose behaviour is disruptive, unsafe, or inappropriate. No refund will be issued in such cases.

7. INTELLECTUAL PROPERTY

All content provided as part of the Membership, including audio, written content, prompts, frameworks, and recordings, remains the intellectual property of Nikki Gundy On Track Limited.

You may not:

  • copy, reproduce, distribute, or sell any Membership content

  • share Membership materials with third parties

  • use Membership content for commercial purposes

8. PRICING AND PAYMENT

8.1 Fees

Membership fees are displayed at the point of purchase and are charged on a recurring basis unless cancelled in accordance with these terms.

8.2 Payment

Payments are taken in advance. If payment fails, we may suspend access until payment is resolved.

9. OUR RIGHT TO MAKE CHANGES

We may make reasonable changes to the Membership, including:

  • delivery methods

  • content format

  • community structure

If changes materially affect the Membership, we will notify you in advance.

10. CANCELLATION AND TERMINATION

10.1 Your right to cancel

You may cancel your Membership after the initial 8-week minimum commitment by providing a minimum of fourteen (14) days’ written notice by email to hello@nikki-gundy.com.

Your Membership will remain active and payment obligations will continue during the 14-day notice period.

Cancellation will take effect at the end of the notice period, not on the date the cancellation request is received.

10.2 Cooling-off period

You have a statutory 14-day cooling-off period from the date of purchase provided no Membership content has been accessed. Once access to the Membership begins, this right is waived.

10.3 No refunds

Except where required by law, we do not offer refunds for:

  • partial billing periods

  • unused time

  • missed participation

  • failure to engage with the Membership

11. OUR RIGHT TO SUSPEND OR TERMINATE

We may suspend or terminate your access to the Membership if:

  • payment is not made when due

  • you breach these terms

  • your behaviour negatively impacts the community

Where reasonably possible, we will provide notice before taking such action.

12. LIMITATION OF LIABILITY

12.1 Standard of service

We will provide the Membership using reasonable care and skill.

12.2 No guarantees

We do not guarantee specific results or outcomes.

12.3 Limitation

To the fullest extent permitted by law, our total liability to you under this Agreement is limited to the total fees paid by you for the Membership.

Nothing in these terms limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or fraud.

13. DATA PROTECTION

Your personal data will be handled in accordance with our Privacy Policy, available at nikki-gundy.com.

14. GENERAL TERMS

  • Nothing in this Agreement creates a partnership, employment, or agency relationship

  • We may transfer this Agreement to another organisation without affecting your rights

  • If any part of this Agreement is found unenforceable, the remainder will remain in force

  • Failure to enforce any part of this Agreement immediately does not waive our right to enforce it later

15. GOVERNING LAW

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

CANCELLATION NOTICE (EMAIL FORMAT)

To cancel your Membership after the minimum commitment period, email:

  • your full name

  • the email address used to join

  • “OnTrack in 8 Cancellation” in the subject line

Please note:

  • cancellations must be submitted by email

  • a 14-day notice period applies

  • access and billing continue during the notice period
